Calcutta Motor Sports Club (CMSC) – Wall of Honour
Terms and Conditions
These Terms and Conditions ("Terms") govern participation in the Wall of Honour initiative of the Calcutta Motor Sports Club Limited (CMSC), India's first motorsports club founded/established in 1949. By applying for inclusion on the Wall of Honour and by making the contribution, you ("the Donor" / "the Participant") agree to be bound by the following Terms.

Eligibility
- Any individual who is 18 years old or above that age may apply for inclusion. By making the application, individuals certify they are 18 years old or above that age.
- The Club reserves the right to verify the identity of the individual Donor in compliance with applicable Indian laws, including the Income Tax Act, 1961 and the Foreign Contribution (Regulation) Act, 2010 ("FCRA"), where applicable.

Contribution
- Inclusion on the Wall of Honour is subject to a voluntary donation (contribution) made by the Donor to the CMSC.
- The minimum contribution (voluntary donation) amount shall be determined by the Club and may be revised from time to time.
- Contributions shall only be payable through the payment gateway approved by CMSC.
- Contributions once received are non-refundable under any circumstances.

Plaque Display
- Each Donor's name and city (and no additional details) will be inscribed on a digital plaque on the Wall of Honour hosted on the official CMSC website.
- The Club reserves the exclusive right to determine the design, placement, and order of plaques.
- Inclusion on the Wall of Honour is purely honorary and does not create any legal rights, financial rights, membership rights, governance rights, voting rights, intellectual property rights or any other rights whatsoever in CMSC.
- Nothing in these Terms shall be construed to create any partnership, agency, joint venture, or employment relationship between the Donor and CMSC.

Donor Representation and Warranties
- The Donor affirms that all the information provided (name, address, city, country, email) is accurate and lawful.
- The Donor warrants that contributions are made from legitimate sources and are not in violation of Indian or international law, including money laundering or anti-terrorism statutes.
- The Wall of Honour is currently not available to Donors paying in foreign exchange. At present, CMSC is unable to accept contributions in foreign exchange. CMSC does not accept contributions from foreign sources as defined under the Foreign Contribution (Regulation) Act, 2010. Only contributions made in Indian Rupees (INR) through Indian domestic sources will be considered. Donors residing in countries other than India can make contributions in Indian Rupees (INR) through Indian domestic sources. Foreign nationals or Persons of Indian Origin may participate only if the contribution originates from an Indian domestic, non-foreign source in Indian Rupees.
- For KYC Compliance, if required at any point in time, the CMSC may request PAN, address proof, or any other KYC documentation required under Indian law, including but not limited to the Income Tax Act, 1961 and the Prevention of Money Laundering Act, 2002. CMSC reserves the right to reject Donors where such documents are not provided if required at any point in time.

Approval and Rejection
- The Club will regularly audit the Wall of Honour. The CMSC reserves the absolute right to continue to accept, or to reject, any Donor and corresponding Wall of Honour plaque, at its sole discretion, without assigning reasons. If any Donor and corresponding Wall of Honour plaque is rejected after an audit, contributions received shall not be refunded under any circumstances.
- When the Wall of Honour is audited, the CMSC reserves the right to remove Wall of Honour plaques containing names or information that are false, offensive, misleading, defamatory, impersonate another person, violate intellectual property rights, or breach any applicable Indian laws. In such cases, contributions received shall not be refunded under any circumstances.

Intellectual Property
- The Wall of Honour, including its design, layout, and content, remains the intellectual property of CMSC.
- Donors waive any claim to intellectual property rights arising from inclusion on the Wall of Honour.

Data Protection and Privacy
- Donor details (name, city) will be publicly displayed on the website. By applying, the Donor consents to such publication.
- CMSC will protect all other personal and financial details of Donors in compliance with applicable Indian data protection principles.
- Payment information is handled by authorised payment processors, and CMSC does not store sensitive financial data.

Tax Benefits
- CMSC is a Section 8 Company registered under the Companies Act, 2013.
- Contributions (voluntary donations) may qualify for tax benefits, subject to prevailing rules.
- It is the sole responsibility of the Donor to verify eligibility and claim such benefits.

Limitation of Liability
- CMSC makes no warranties or guarantees regarding visibility, duration, or prominence of plaques on the website.
- CMSC shall not be liable for any loss, damage, or claim arising from the Donor's participation in the Wall of Honour, including technical disruptions or downtime. CMSC does not guarantee uninterrupted availability of the Wall of Honour webpage. Scheduled maintenance or unavoidable technical issues may temporarily affect plaque visibility.

Indemnity and Force Majeure
- The Donor agrees to indemnify, defend and hold harmless CMSC, its officers, directors, employees, and affiliates from and against any claims, liabilities, losses, damages, costs, or expenses arising out of (a) false or misleading information provided by the Donor, (b) unlawful sources of funds, or (c) violation of these Terms.
- CMSC shall not be liable for any failure or delay in performance of its obligations due to events beyond its reasonable control, including natural disasters, acts of God, war, terrorism, government actions, internet outages, or technical failures.

Modification and Termination
- CMSC reserves the right to modify, suspend, or terminate the Wall of Honour initiative at any time without providing any explanation.
- In such an event, contributions already received shall not be refunded.
- CMSC reserves the right to amend, modify, or update these Terms at any time.

Governing Law, Jurisdiction and Severability
- These Terms shall be governed by and construed in accordance with the laws of India.
- Any dispute shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India.
- If any provision of these Terms is held to be invalid or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.

Acceptance
By proceeding with the application and completing the process by making the contribution, the Donor acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
